PROPOSED CLASS ACTION AGAINST ALBERTA GOVERNMENT TO BE DISMISSED

On September 5, 2018, a proposed class action was launched against His Majesty the King in Right of Alberta on behalf of a class of individuals who were subject to a policy that permitted the Alberta government to continue to keep individuals who had been acquitted at trial for criminal matters, had charges stayed or withdrawn, or been granted non-custodial sentences, in custody to process their release. Individual class members’ limitation period to bring their own lawsuit was suspended upon the launching of this claim.

In May 2022, Nanda & Company ceased to act for the Plaintiff in the lawsuit, and the Plaintiff proceeded in the matter as a self-represented litigant. On October 16, 2023, the Honourable Justice J.T. Henderson ordered that this action be dismissed pursuant to Rule 4.33(2) of the Alberta Rules of Court, effective February 8, 2024. With the dismissal of this lawsuit, individual class members’ limitation periods to bring their own lawsuit will begin running again on February 8, 2024.
